1. All Sales Are Final

All sales of products and services from Bookworm Delights are final. We do not offer refunds, returns, exchanges, or credits for any products purchased from our store, whether in-person or online, except where required by Saskatchewan consumer law.

2. All Sales Are "As-Is" / No Warranty

All products are sold on an "as-is" and "where-is" basis. To the fullest extent permissible by law, Bookworm Delights disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability: We do not guarantee that a product is of average or acceptable quality.
  • Implied warranties of fitness for a particular purpose: We do not guarantee that a product will work for your specific need or is compatible with your specific setup.
  • Warranties of non-infringement: We do not guarantee that a product is free from claims of intellectual property infringement.

This includes, but is not limited to, the functioning of electronic components, the condition of cosmetic items (e.g., scratches, wear, sun-fading), and the completeness of product packaging (e.g., manuals, original boxes).

3. Product Description & Condition

We make every effort to accurately display and describe our products, including their features, specifications, and condition. However, we do not warrant that product descriptions, photographs, or other content are accurate, complete, reliable, current, or error-free. Minor variations in condition or appearance from website images are to be expected and do not constitute a basis for a return or refund.

4. Customer Responsibility & Due Diligence

The customer assumes all responsibility for the selection and suitability of the product. Before you buy, you agree that it is your responsibility to:

  • Carefully read the entire product description, including any notes on condition or functionality.
  • Review all provided product photographs.
  • Ensure the product is compatible with your hardware, software, and regional standards (e.g., NTSC vs. PAL).
  • Contact us via our contact form to ask any and all questions you may have about a product before completing your purchase.

5. Digital Products & Services

Due to the nature of digital content, any sale of digital products, codes, or services is irrevocably final and non-refundable.

6. Incorrect or Damaged Orders

While all sales are final, we are committed to customer satisfaction. If you believe you have received an incorrect item (different from what you ordered) or if your order arrived with damage that was not described, you must contact us within 48 hours of receiving the shipment. We will review each situation on a case-by-case basis. Please note that we may require photographic or video evidence of the issue.

If our team determines that an order arrived damaged through no fault of your own, we may issue a refund in the form of store credit. This credit will be automatically applied to your account and can be used for a future purchase, giving you a fresh start with a new product. Please note that cash refunds are typically not available in these specific cases. Original Item must be returned to us for store credit to be issued to account holder.

7. Unclaimed or Refused Shipments

If a shipment is refused by the recipient, unclaimed, or undeliverable and is returned to us, the original shipping costs are non-refundable. A restocking fee may be applied before any balance is refunded, or the order may be cancelled without a refund at our discretion.

8. Governing Law

This Refund Policy and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Saskatchewan and the laws of Canada applicable therein.
